Can I file a green card for my son, even though he was included in the initial filing done by my daughter?

Q: I got my green card via my daughter who is a U.S citizen. I want to bring my 16 years old son from China to U.S. He was included in the initial filing done by my daughter, his sister. Can I also file I-130 for him?

A: Immediate relative petition must be filed individually, so your daughter cannot include your son in her petition for you. She can petition for her brother but that will take more than 10 years. You can petition your son and it will take 3-4 years. File new I-130 for your son with Service Center.
